Terms of Service & Acceptable Use PolicyModification SilverSite Media reserves the right to update this Policy at any time, and it will be immediately effective upon posting to our website, www.silversitemedia.com. It is your responsibility as a client to stay current with updates made to this Policy.
Disclosure to Law Enforcement: We specifically prohibit the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition SilverSite Media shall have the right to terminate all service set forth in this Agreement.
ServicesSilverSite Media accepts no responsibility for damages induced to sites/servers by 3rd parties and by any kind of network or server attacks.
Domain Registration Costs:Please note that fees payable to **domain registration and renewal costs are non-refundable** SilverSite Media accepts no responsibility for any typing errors (spelling mistakes) you make when ordering a domain name with us.
Payment:We will issue invoices on a standard monthly basis, (normally towards the end of the month) payment is due before the 7th of the month that the invoice is made out for. Our current payment method is EFT/Internet or Direct Deposit.
Failure to Pay: The Company may temporarily suspend service upon the failure of Subscriber to pay charges when due. The account will be reactivated as soon as the money is reflected in our account. We do not charge a reactivation fee.
SPAM and Unsolicited Commercial Email (UCE): SilverSite Media takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of SilverSite Media may not use or permit others to use our network to transact in UCE. Customers of SilverSite Media may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.
IP Address Ownership: If SilverSite Media assigns Customer an Internet Protocol address for Customer's use, the right to use that Internet Protocol address shall belong only to SilverSite Media, and Customer shall have no right to use that Internet Protocol address except as permitted by SilverSite Media in its sole discretion in connection with the Services, during the term of this Agreement. SilverSite Media shall maintain and control ownership of all Internet Protocol numbers and addresses that may be assigned to Customer by SilverSite Media, and SilverSite Media reserves the right to change or remove any and all such Internet Protocol numbers and addresses, in its sole and absolute discretion. Our allocation of IP addresses is limited by RIPE's new policies. These policies state that use of IP addresses for IP based virtual hosts will not be accepted as justification for new IP addresses.
Bandwidth and Disk Usage: Customer agrees that bandwidth shall not exceed the number of megabytes per month and disk usage shall not exceed their quota for the Services ordered by Customer on the Order Form. Sites that consume over our monthly bandwidth limit (according to the package) are automatically disabled and will show a bandwidth overusage note when trying to view the website and client must look into upgrading thier hosting package for better bandwidth needs.
The following scripts are banned from use on our shared and reseller hosting and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc. IRC egg drops BNC's Shell, SSH, Telnet Scripts and Shell, SSH, Telnet Alternatives. Proxy servers Mail bombers Torrent scripts Anonymous mailers IP spoofers Port scanners nph-proxy UBB (Ultimate Bulletin Board, all versions) Any script that uses & processes a massive number of flatfiles or large flatfile databases
Shared Hosting Resource UsageSilverSite Media's hosting accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination or suspension of your account without notice. You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of SilverSite Media's systems or Hosting. SilverSite Media reserves the right to terminate or limit such activities.
System and Network Security: Users are prohibited from violating or attempting to violate the security of the SilverSite Media Network. Violations of system or network security may result in civil or criminal liability. SilverSite Media will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing". Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Taking any action in order to obtain services to which such User is not entitled.
Suspension of Service or Cancellation: SilverSite Media reserves the right to suspend network access to any customer if in the judgment of the SilverSite Media network administrators the customer's server is the source or target of the violation of any of the other terms of the TOS or for any other reason which SilverSite Media chooses. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete.
ContentSilverSite Media's current network does allow legal Adult Content on its servers but at the sole disgression of SilverSite Media and its Network Operation Center. Child pornography is Prohibited and will result in suspension of service
Sites containing or linking to material that may be considered detrimental to the public health, safety, or welfare. (Such as, but not limited to: Anarchists Cookbook, bomb making, weapon information, or anything else that may be considered detrimental or illegal.)
SilverSite Media does not allow, illegal software, music, torrents on their servers.
BackupsSilverSite Media does accounts backup's daily, however these backups are in NO WAY GUARANTEED! SilverSite Media does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on SilverSite Media's part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.
Violations of the AUP will result in the following: A warning notification sent via email, Emailwith 24 hours notice for resolution: 24 hours is the standard notification; situations involving law enforcement, phishing scams, fraud, password harvesting, network interference, Denial or Disruption of service, IRC related misuse, or other malicious activity can reduce the notification time frame.
First Violation : Any user, which SilverSite Media determines to have violated any element of our AUP (Acceptable use Policy), shall receive an e-mail, warning them of the violation. The service may be subject at SilverSite Media's discretion to a temporary suspension pending a client's agreement in writing to refrain from any further violations. Second Violation :
Any client that SilverSite Media determines to have committed a second violation of nay element or portion of the AUP shall be subject to immediate suspension or termination of service without further notice. We reserve the right to drop the section of IP space involved in any SPAM or Denial-of-Service (Dos) complaints if it is clear that the offending activity is causing great harm to parties on the Internet. In particular, if open relays are on your network or a customer's network, or if denial-of-service attacks are originating from your network. In certain rare cases, we may have to take this action prior to attempting to contact you.
SilverSite Media is not responsible for any damages your business may suffer. SilverSite Media does not make implied or written warranties for any of our services. SilverSite Media denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, server downtime and any and all service interruptions caused by SilverSite Media.
Privacy StatementSilverSite Media has a policy to respect and protect the privacy of its customers and their information that is stored with SilverSite Media. SilverSite Media will only access and disclose information as necessary to comply with applicable laws and government requests, to provide the SilverSite Media Services, to operate or maintain its systems or to protect itself or its customers.
